The key point
Let the notice define the required actions and timing. A clean-up response may involve investigation, reporting and monitoring as well as physical works.
A clean-up notice can involve more than removal
The NSW EPA’s powers and notices guideline explains that clean-up action can include preventing or reducing pollution, testing, monitoring and reporting. Notices may be directed to owners or occupiers as well as people reasonably suspected of causing or contributing to a pollution incident. [1]
Failure to comply without reasonable excuse is an offence. The guideline also states there is no statutory right of appeal against a clean-up notice. Get prompt legal advice if you need advice about your rights or the validity of the notice. [1]
Set up a response register
A useful first step is to turn the full notice into a working register. For each requirement, record the deadline, the person coordinating it, the evidence needed and the current status. Keep the original wording beside your summary so details are not lost.
- Keep the notice, attachments and regulator correspondence together.
- List the assessment and reporting tasks separately from site works.
- Record who is responsible for each task and when their input is needed.
- Keep a record of submissions, delivery receipts and further directions.
Connect technical advice with practical delivery
Avoid treating the first earthmoving quote as the entire response. Ask what must be understood about the affected area before a contractor can price an appropriate scope, what environmental expertise is needed and what evidence will demonstrate completion.
The EPA’s guidance recognises that notices can require progress updates as well as clean-up actions. Build those reporting steps into the programme. Seeking clarification or discussing timing should not be treated as changing the notice; obtain and follow any formal variation. [1]
Bring your notice to FIDES
FIDES can discuss environmental assessment coordination, remediation planning and civil delivery. That connection helps you organise the people and information around one response. Share the full document, your property address and the earliest deadline so we can discuss an appropriate scope.
